Terms of Service
These terms govern your access to and use of Fjord, including AI tutoring, subscriptions, and learning tools.
Effective: August 12, 2026 · Last updated: August 13, 2026 · Version: 2026-08-13-2
1. Agreement and operator
By creating an account, affirmatively accepting a current version of these Terms, or continuing after a required policy-update acceptance, you agree to these Terms and acknowledge the Privacy Policy. The Ontario sole proprietor carrying on business as Fjord Learning operates the service from Ontario, Canada. Fjord is a business name, not a corporation. Notices may be sent to PO Box 80003, Hamilton RPO Concession, ON L9A 0A6, Canada.
2. Eligibility and accounts
Fjord is currently for people aged 18 and older. You must affirmatively confirm that you are at least 18 and be legally capable of entering this agreement. Fjord is available internationally, subject to applicable law and any geographic restrictions Fjord may impose. Keep credentials secure, provide accurate information, and notify support@usefjord.com of suspected account misuse. You are responsible for activity under your account except where law provides otherwise.
3. The service and AI tutor accuracy
Fjord provides AI-assisted language practice, translations, corrections, pronunciation tools, vocabulary review, progress estimates, and related features. Like human tutors, Fjord’s AI tutors may occasionally make mistakes in translations, corrections, explanations, grammar guidance, vocabulary, pronunciation guidance, regional or register distinctions, and other educational content. Fjord does not guarantee that tutor-generated content is error-free, complete, or perfectly suited to every dialect, region, or context.
AI outputs are educational aids, not certified instruction, professional advice, professional certification, or guaranteed statements of fluency. Use reasonable judgment and independently verify important information. If you suspect a tutor mistake, use the in-conversation reporting control; reporting permits authorized quality reviewers to inspect that response and limited relevant context to investigate it.
Fjord may change, test, suspend, or discontinue features. We aim for reliable service but do not promise uninterrupted availability, permanent retention of any particular feature, or specific learning results.
4. Acceptable use
Do not use Fjord to break laws; harm, threaten, exploit, or harass others; generate sexual exploitation content; evade safety controls; access another person’s data; probe or disrupt systems; distribute malware or spam; reverse engineer protected portions except where law permits; automate abusive traffic; or infringe intellectual-property, privacy, or other rights.
Fjord may refuse unsafe requests, limit traffic, apply cooldowns, preserve security evidence, suspend access, or terminate accounts when reasonably necessary to protect users, providers, or the service.
5. Your content and licence
You retain rights you have in content you submit. You grant Fjord a limited, worldwide licence to host, transmit, encrypt, decrypt, reproduce, and process that content only as needed to operate, secure, improve, and support the service, comply with law, and enforce these Terms. You must have the right to submit the content.
6. Fjord content
Fjord’s software, design, branding, prompts, documentation, and service content are owned by Fjord or its licensors. Subject to these Terms, you receive a limited, personal, non-transferable, revocable right to use the service for its intended purpose. No ownership rights are transferred.
7. Plans, billing, refunds, and taxes
Displayed paid prices are in Canadian dollars and are exclusive of applicable taxes unless checkout expressly states otherwise. Paid plans provide the message allowance and billing period shown before purchase. Multi-month plans may be charged upfront. Stripe processes payments, collects the billing location needed for tax calculation, and shows the applicable tax and final total before you confirm a purchase. Fjord configures registrations in Stripe Tax and does not use a single manual tax rate for every customer.
Subscriptions renew automatically at the end of each billing period unless cancelled before renewal. Renewal tax is determined using the information and registrations applicable at that time. You may cancel at any time; cancellation stops future renewals and, unless applicable law requires otherwise, access continues through the already-paid period. The first subscription purchase by an account is eligible for Fjord’s 14-day first-purchase refund guarantee. Renewals and used bonus messages are generally non-refundable, subject to mandatory rights and the complete Refund, Cancellation & Renewal Policy, which forms part of these Terms.
8. Suspension and termination
You may stop using Fjord and delete your account from Settings. Fjord may suspend or terminate access for material breach, fraud, non-payment, abuse, security risk, or legal necessity, using reasonable notice where appropriate. Provisions that by their nature should survive—including ownership, payment obligations, disclaimers, liability limits, and dispute terms—continue after termination.
9. Disclaimers
To the maximum extent permitted by law, Fjord is provided “as is” and “as available.” Fjord disclaims implied warranties including merchantability, fitness for a particular purpose, accuracy, non-infringement, error-free AI-generated educational content, and uninterrupted availability. Use reasonable judgment and report suspected tutor mistakes through the available reporting mechanism. Some jurisdictions do not allow certain disclaimers, so they may not apply to you.
10. Limitation of liability
To the maximum extent permitted by law, Fjord and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, or business interruption arising from the service. To the maximum extent permitted by law, Fjord’s aggregate liability arising out of or relating to the service will generally be limited to the amount you paid Fjord during the 12 months immediately preceding the event giving rise to the claim.
This provisional clause does not exclude liability that legally cannot be excluded and does not waive non-waivable consumer, privacy, or statutory rights. It requires lawyer review before major commercial scale.
11. Indemnity
Where permitted by law, you agree to indemnify Fjord against third-party claims arising from your unlawful use, your submitted content, or your material breach of these Terms. This does not apply to the extent a claim results from Fjord’s own conduct or where consumer law prevents it.
12. Governing law and disputes
These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law principles. Subject to mandatory consumer protections and non-waivable rights that apply where you live, disputes will be brought before the courts of Ontario, Canada. These governing-law and venue terms require lawyer review before major commercial scale. These Terms do not impose mandatory arbitration or a class-action waiver.
13. Changes and contact
Fjord may update these Terms. Material changes will be communicated and, where required, presented for renewed acceptance. Continued use after an effective change constitutes acceptance only where permitted by law. Contact support@usefjord.com or use the contact form.
